1. General information

These General Contracting Conditions govern the purchase of products through our web site https://laumbriaiberico.es from now on “la Web” or ”LA UMBRÍA S.C.”. By accepting these General Terms and Conditions of Business, the User declares

• Who has read, understands and understands what is stated here.
• Who is a person with enough capacity to hire.
• That you assume all the obligations set forth herein.
• That it has the legal age (18 years) to acquire the products that are offered in the same one.

1. Guided tours to the farm

• Contact and confirmation by La Umbría S.C. of the selected dates will be required, either by telephone, email or the reservations section of the website.
• Schedules: the start of the visits is expected at 10:00 am, with a total duration of 4 hours. During the months of July and August the start will be at 9:00 am. The start time of the visit may be adjusted, by prior agreement with the company.
• Payment can be made at the end of the visit, which is acceptable both in cash and by bank card.
• The client must inform the company if any of the visitors suffers from any type of food allergy, food restriction, or any medical circumstance that may interfere with the normal development of the different activities of the visit.
• The client must make the visit with the appropriate clothing and footwear for the conditions of the environment, being recommended comfortable and breathable sportswear, closed shoes appropriate to the terrain, and clothing suitable for rainy days if applicable, as well as sun protection.
• Throughout the visit, physical contact of visitors with farm animals or wild fauna and flora that may be encountered during the visit is prohibited.
• The company is not responsible for the consequences arising from the improper conduct of visitors or the failure to comply with any of the visiting rules written in this document.

2. Purchase procedure

The procedure to contract the products offered throughhttps://laumbriaiberico.es, is the following:

Identificación: The Partner must identify himself through “MI CUENTA” or “SIGN IN”. If you are not a member and wish to become one, you must provide the minimum data required for registration. If you want to know the conditions about the processing of your personal data you can read our privacy policy (política de privacidad). Once this registration has been made in a valid manner, you will receive an e-mail warning that you must confirm this registration in order to start making your purchases. You can also make a purchase as a guest user (usuario invitado) without needing to register..

Product selection: The User who wishes to acquire a product offered through the Web must mark the button “ADD TO CART” (AÑADIR AL CARRITO). Before marking this “ADD TO CART” button (AÑADIR AL CARRITO), the User can consult the detailed description of the product (price, weight, denomination, ingredients) that he/she wishes to acquire. The User may continue with the purchase process until he has selected all the products he wishes to order through the Web.

Purchase Confirmation: Once all the products have been selected, the User will be able to see the selected products by clicking on the “VIEW CART” VER CARRITObutton where a summary of the order will be shown. In case you wish to continue shopping, you must click on the “CONTINUE SHOPPING” button(CONTINUAR COMPRANDO). Otherwise, it will mark the “FINISH PURCHASE” button (FINALIZAR COMPRA).

Customer data and secure payment: The User must fill in a specific form related to the shipment of the order. Users who have already registered their shipping data at an earlier time should not fill in this information again. Otherwise, before confirming the payment details, you must include the order’s shipping details, as well as the order’s billing details. Then the User must choose a payment method between credit card payment or Paypal to confirm the order. Before passing the next step the User can, before validating, see a summary of the order. Then the button “FINISH PURCHASE” (FINALIZAR COMPRA) must be checked and you will be redirected to the payment platform that corresponds to the chosen payment option.

Payment confirmation: Once the order has been confirmed, the User is shown confirmation of receipt of the order. The order will be processed once LA UMBRIA S.C. lreceives confirmation of the payment of the order according to the form chosen by the User in the step “Customer data and secure payment”. The User can continue shopping after this purchase process has been completed. In certain cases and in order to prevent possible fraud, La Umbría S.C. reserves the possibility of asking a client for a specific form of payment in the event that the identity of the buyer is not reliably proven.

3. Delivery conditions

LA UMBRIA S.C. sends its products exclusively to the E.E.C. The transport costs, depending on the area where the products are sent, will be paid by the buyer. These shipping costs vary according to the shipping zone, and the total weight of the order.

• From 100€ of purchase, LA UMBRIA S.C. will not invoice shipping costs for delivery to any address in mainland Spain, the Balearic Islands and mainland Portugal.
• A partir de 300€ de compra, LA UMBRIA S.C. no facturará los gastos de envío para la entrega a cualquier dirección de España peninsular, Baleares, Ceuta, Melilla, Canarias, Francia, Belgica, UK, Holanda, Italia, Alemania y Portugal peninsular

Orders will be delivered to the delivery address freely designated by the User, within the period established in the product file itself. LA UMBRIA S.C. has contracted with its logistics partner the possibility of a second delivery attempt, at no additional cost and coordinated with the User, in case the User is not at the delivery address on the first delivery attempt. However, LA UMBRIA S.C. will not assume any responsibility when the delivery of the product does not take place as a result of the inaccuracy or falsity of the data provided by the User for this purpose, as well as in the event that the delivery cannot take place due to causes beyond LA UMBRIA S.C., as is the absence of the addressee in the two delivery attempts set out in the contract conditions.

LA UMBRIA S.C. cannot be held responsible for delays in the delivery of orders for reasons not directly attributable to LA UMBRIA S.C., nor for causes beyond the company’s control such as fortuitous cases and force majeure.

4. Prices of the products offered on the website

The price of the products offered on https://laumbriaiberico.esinclude, unless expressly indicated otherwise, the Value Added Tax (VAT) or other taxes that may be applicable and, in any case, will be expressed in the Euro currency (euros). If the destination of an order is a place that applies customsduties, the costs derived from the duties must be paid at destination by the buyer.

Due to the handcrafted production and the way of presentation, some of the products shown are shown in a certain range of weights, among which the different pieces vary. A price is established for each of the products according to the data in their descriptive file.

For any information on the order placed, the User may send an email to comercial@laumbriaiberico.es. In any case, you must indicate the order number that was assigned to you and indicate it in the purchase confirmation email.

5. Right of Withdrawal

You have the right to withdraw from this contract within 14 calendar days without giving any reason. The withdrawal period shall expire 14 calendar days after the conclusion of the contract. Excluded from this right are products acquired once opened or any other that is delivered sealed and whose seal is removed, as well as those that expire quickly or are directly excluded in Article 103 of the Consumer Law.

You may use the model withdrawal form below, although its use is not obligatory, and you may use any other unambiguous statement. If you use this option, we will promptly notify you in a durable medium (for example, by e-mail) of the receipt of such a withdrawal. In order to comply with the withdrawal period, it is sufficient that the communication concerning your exercise of the right of withdrawal is sent before the expiry of the withdrawal period.

Consequences of withdrawal: In case of withdrawal on your part, we will refund all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the least expensive standard delivery method that we offer) without any undue delay and in any case no later than 14 days from the date on which you inform us of your decision to withdraw from this contract. We will make such refund using the same payment method you used for the initial transaction. We may withhold reimbursement until we have received the goods. Deberá usted devolver o entregar los bienes a nosotros mismos sin ninguna demora indebida y, en cualquier caso, a más tardar en el plazo de 14 días a partir de la fecha en que nos comunique su decisión de desistimiento del contrato. Se considerará cumplido el plazo si efectúa la devolución de los bienes antes de que haya concluido el plazo de 14 días. La mercancía sé entregará con los precintos y envases intactos en su embalaje original. Deberá usted asumir el coste directo de devolución de los bienes. Solo será usted responsable de la disminución de valor de los bienes resultante de una manipulación distinta a la necesaria para establecer la naturaleza, las características y el funcionamiento de los bienes

Modelo de formulario de desistimiento: el presente formulario sólo se debe cumplimentar y comunicar si desea desistir del contrato, siendo necesario incluir todos los campos que se citan a continuación:

6. Legislación aplicable y jurisdicción competente

Estas Condiciones Generales se rigen por la ley española. Si usted está contratando como consumidor, para la resolución de posibles disputas, las partes se comprometen a someterse, a su elección, y renunciando a cualquier otro fuero que pudiera corresponderles, a los juzgados y tribunales de la ciudad correspondiente al domicilio del Socio o Usuario. Si usted está contratando como empresa las partes establecen someterse a los Juzgados y Tribunales de Sevilla renunciando expresamente a su fuero propio si lo tuvieran
